When a child or adolescent needs special help managing behavior and/or coping with the symptoms of mental health disorders, families usually have to move through a maze of county, state, and federal regulations. We have invited a team of lawyers and other advocates to help you understand your rights and responsibilities as a consumer of these services. The training will help you target your concerns and interventions, avoid unneeded conflicts, and focus on problem-solving, all to the benefit of your child’s progress.

I. Law Primer: An Introduction to Systems and Laws

Speakers: Kosnoff and Goetz

• IDEA: key provisions of Special Education Law and recent decisions regarding residential and private school placements, and the issue of educational benefit
• Section 504 and the Americans with Disabilities Act: federal laws providing protection from discrimination based on disability.
• Titles VI and IX: other federal non-discrimination laws
• Minnesota Human Rights Act: state non-discrimination laws
• NCLB No Child Left Behind: Federal accountability law; when it’s better than IDEA
• Minnesota Pupil Fair Dismissal Act: information on suspension, expulsion
• Minnesota Children’s Mental Health Act: Mental health services which counties are mandated to provide & fiscal limitations on those mandates,
• New Mn Statute 260D: the new law regarding legal custody of children with disabilities in placement
• Speakers will also touch on Juvenile Courts, protection against maltreatment, and bullying and harassment

III. My Idea and Your Idea of Best Interests May Not Be the Same: Avoiding and Resolving Disputes

More about the speakers

Kathy Kosnoff, Attorney at Law, currently has a private practice in Minneapolis—Solutions & Resolutions Consulting, Mediation, & Training Services. Kosnoff was an attorney at the Disability Law Center for more than 15 years.

Amy Goetz, Attorney at Law, is the founder of the School Law Center in Saint Paul, focusing on the rights of students and families in education and school law disputes. Ms. Goetz has worked in education law since 1995, first as a staff attorney with the Minnesota Disability Law Center in Minneapolis, then as a complaint investigator at the Minnesota Department of Education.

Guest speakers invited to present include: Michael Browne, In-House Counsel, Minnesota Department of Human Rights; Lisa McNaughton, Managing Attorney, Juvenile Court, Office of the Public Defender, Hennepin County; and Dr. Richard S. Zigler, PhD, LP, Pediatric Neuropsychology, University of Minnesota.
